UPDATE: Elgin Man Dies in Custody After Arrest For Setting Out Fake Bomb

A 51-year-old Elgin man arrested on felony charges for setting out a fake bomb during a court-ordered eviction Tuesday morning was found unresponsive in the booking area of the Kane County Adult Justice Center on Tuesday afternoon and later pronounced dead at Delnor Hospital.

According to a Tuesday Kane County Sheriff’s Office news release, sheriff’s deputies reported at around 8:30 a.m. Tuesday, Jan. 5, 2016, to the home of Piotr Dutkiewicz at his residence in the 600 block of Forrest Avenue in Elgin to conduct an eviction. According to the release, Dutkiewicz exited the house, put what appeared to be a large battery with wires taped to it on the ground and said one word: “Bomb.”

Dutkiewicz was immediately taken into custody, and a woman identified by the Sheriff’s Office as Dutkiewicz’ “ex-girlfriend” exited the residence without incident.

A member of the Kane County Sheriff’s Office bomb squad responded to the residence and “quickly determined the suspicious device was not real,” the release said.

Dutkiewicz was arrested on charges of disorderly conduct and threatening a public official, both Class 3 felonies.

Dutkiewicz was being processed and had not yet been to bond call on the charges at around 4:45 p.m. Tuesday, when he was found unresponsive in the bathroom of the Justice Center booking area, according to a press release issued Wednesday. Officers and medical staff immediately began life-saving measures, and Dutkiewicz was transported to Delnor Hospital, where he was pronounced deceased.

Sheriff’s detectives are investigating the incident. The Sheriff’s Office news release said it does not appear any foul play was involved.

The charges against Dutkiewicz, both Class 3 felonies, are not proof of guilt. A defendant is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove his or her guilt beyond a reasonable doubt.
