According to the new Illinois laws regarding adult-use cannabis, units of local government have the authority to regulate the sale of marijuana products.

The Kane County Board voted in November to prohibit the sale of marijuana in rural areas. Municipalities in Kane County have chosen to either opt in or opt out of the new state law, although some are undecided.

The Chicago Tribune on Monday (Dec. 30, 2019) posted a list of communities that have approved the sale, those that have prohibited the sale and those that are undecided. The Daily Herald on Monday posted a list of communities that have allowed or prohibited sales.

It should be noted that cities or village that have approved the sale have often set limits on the number of establishments allowed. Geneva, for example, will allow just one establishment for the sale of marijuana in city limits.

It also should be noted that municipalities that allow the sale of marijuana products will be able to collect a tax on the sales.

Here are a list of Kane County communities and status, according to the Tribune list and a search of local websites.

Algonquin — prohibited.

Aurora — allowed.

Batavia — prohibited.
