Burning in Kane County — Regulations, Penalties and Where to Report Violations
As we move into the summer season, maybe it’s a good idea to review what you can and can’t burn in unincorporated areas of Kane County.
Remember, if you’re inside city limits, your first priority is to check with your city government website. Ordinances vary from town to town, and there’s a lot of attention these days to backyard fire pits, so know what you’re doing before you burn.

Kane County Burning Regulations
- Burning of garbage is not permitted at any time.
- Burn on sunny days from 10 a.m.to 3 p.m.
- Do not burn when wind exceeds 10 mph.
- Do not burn within 20 feet of any building, structure or property line.
- Any burning must be supervised until it is extinguished.
- Supervised means you are there and water is at hand.
- Burning for prairie restoration or fire fighting training is permitted.
- Burning of brush in fireplaces and self-contained out- door wood-burning devises is permitted.
- Burning of brush for recreational fires is permitted, but no larger than 3 feet by 3 feet by 3 feet.
- Ceremonial Fires for a private or public event: Notice must be given to the local fire department, and a permit must be obtained from the Health Department.
