South Elgin Man Pleads Guilty to Stalking Former Girlfriend

A South Elgin man will go to prison for stalking his former girlfriend, and later battering her.

David L. Bognar, 50, of the 600 block of Lucille Street, South Elgin, on Friday, Oct. 31, 2014, agreed to a sentence of eight years in the Illinois Department of Corrections in exchange for a guilty plea to aggravated stalking, a Class 3 felony, and domestic battery, a Class 4 felony.

Associate Judge Thomas Stanfa accepted the plea.

During the plea hearing, prosecutors presented evidence that in March 2013 on multiple occasions Bognar unlawfully called the victim’s cell phone. Also, Bognar called the victim’s place of work and left messages for her with co-workers. In addition, Bognar visited the victim’s place of employment. At the time, the victim had obtained from the court an order of protection that prohibited Bognar from making such contact with her. Bognar’s actions caused the victim emotional distress.

Prosecutors also presented evidence that on June 2, 2013, Bognar, having been previously convicted of domestic battery, battered the victim.

The sentence is four years in prison for each count, to be served consecutively.

According to Illinois law, Bognar is eligible for day-for-day sentencing. He was given credit for at least 606 days served in the Kane County jail.

The case was prosecuted by Kane County Assistant State’s Attorney Megan Baxter and Jamie Mosser.
