A Montgomery man was charged with aggravated assault and an Aurora man was held on warrants for residential burglary and unlawful possession of a controlled substance following a Monday-night incident that involved action by the Kane County SWAT team.

According to a Wednesday press release from the Kane County Sheriff’s Office, sheriff’s deputies were dispatched to a residence on Johns Lane in unincorporated Aurora Township for a report that two subjects were involved in a dispute over a Facebook post.

During the confrontation, one subject pointed a gun at another person’s head.

After speaking to the victim, deputies went to 6 Johns Lane to speak with the suspect, the Sheriff’s Office press release said. Deputies tried for approximately 15 minutes to get the man to exit the residence. Eventually, a male later identified as Oscar Guzman, 26, of Montgomery, and a 20-year-old female exited the residence.

Deputies took possession of a toy gun that was allegedly used during the altercation, and both subjects were taken into custody. When deputies showed the gun to the victim, however, he said that was not the gun that was used, the press release said.

Deputies learned that there was an unidentified male along with an adult female and a 3-year-old child still in the residence at 6 Johns Lane. On-scene deputies began to attempt to contact the subjects inside the residence for approximately an hour, but they refused to talk to deputies.

Deputies spoke to the subjects, who initially exited the residence at 6 Johns Lane and were told that neither of them knew the male who was still inside the residence with the woman and child, the press release said.

Due to the inability to determine if the woman and child were free to leave or were being held against their will the Kane County SWAT team was called to the scene, the press release said.

After about two-and-a-half additional hours of unsuccessful attempts to contact the subjects, the SWAT team made entry to the home and took into custody the male, later identified as David Oslund, 33, of Aurora.

Sheriff’s Office personnel determined that the woman and child were safe. The woman was taken into custody, and the child was turned over to her father.

After completion of the investigation, it was learned that the woman and child were at the home by their own choice and not being held against their will, the press release said. The two women were released without charges. The two men were transported to the Kane County Adult Justice Center, where Guzman was charged with aggravated assault and Oslund was held on warrants for residential burglary and unlawful possession of a controlled substance.

The charge against Guzman is not proof of guilt. A defendant is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove his or her guilt beyond a reasonable doubt.
