St. Charles Township Fight Ends in Charges Against 2 Men
A Sunday-night fight in rural St. Charles ended with charges filed against the two men involved, according to a Kane County Sheriff’s Office press release.
Kane County sheriff’s deputies along with officers from St. Charles, Wayne and South Elgin Police Department’s responded at around 10:10 p.m. Sunday, May 17, 2015, to a report of a fight in progress involving a large number of subjects on South James Drive in unincorporated St Charles Township.
One of the deputies was confronted by David Griffeth, 35, of St. Charles Township, who refused to comply with instructions to lie on the ground. Griffeth continued to yell at deputies, then took an aggressive stance and attempted to charge at one of the deputies, the press release said. The deputy deployed a taser, but one of the darts missed. After the failed taser deployment, Griffeth was taken into custody without incident, transported to Delnor Hospital, where he was treated and released, and taken to the Kane County Adult Justice Center.
During the investigation, it was discovered that Griffeth and Harvey Gainer, 36, of Elgin were drinking together and at some point got involved in a verbal argument that led to the physical fight between the two subjects, the press release said.
Gainer initially refused to cooperate with deputies and gave them a false name, the press release said. When his actual identity was learned, it was discovered he had four warrants for his arrest. The warrants were for domestic battery, battery, forgery and aggravated battery to a peace officer. Gainer was also treated at Delnor Hospital and taken to the Kane County Adult Justice Center.
Griffeth was charged with resisting/obstructing a peace officer. He was processed at the Kane County Adult Justice Center and released after posting bond. Gainer was charged with resisting/obstructing a peace officer, misdemeanor battery and held on his outstanding warrants.
The charges against Griffeth and Gainer are not proof of guilt. They are presumed innocent and are entitled to a fair trial in which it is the state’s burden to prove guilt beyond a reasonable doubt.
