SAO: Burlington Township Man Charged With Murder in Father’s February Death
A Burlington Township man has been charged with killing his father at the home they shared in far northeastern Kane County.
Daniel M. Rak, 30, of the 13N block of Engel Road, Burlington Township, is charged with first-degree murder, and two counts of aggravated domestic battery, each a Class 2 felony, in the February 2016 death of 58-year-old Jeffrey Rak of Burlington Township.
Kane County State’s Attorney Joseph H. McMahon alleges that between Feb. 11, 2016, and Feb. 14, 2016, Daniel Rak knowingly struck Jeffrey Rak in the head causing great bodily harm and Jeffrey Rak’s death.
Early the morning of Feb. 14, 2016, emergency responders were called to the residence the Raks shared in the 13N block of Engel Road. When they arrived Jeffrey Rak was unresponsive, his face and head showed bruising and swelling, and dried blood was seen on his face. His cause of death was determined to be blunt head trauma.
A warrant for Daniel Rak was issued June 3, 2016, and his bail was set at $950,000 with 10 percent ($95,000) to apply for bond. Daniel Rak was taken into custody at his home at about 5 p.m. June 3, 2016, by Kane County Sheriff’s detectives with assistance from the Kane County Major Crimes Task Force.
Daniel Rak appeared June 4 in Kane County Bond Court. His next court appearance is set for 9 a.m. June 10, 2016, in Courtroom 313 in front of Circuit Judge James C. Hallock at the Kane County Judicial Center.
If convicted of the most serious offense, Daniel Rak would face a sentence of between 20 and 60 years in the Illinois Department of Corrections.
“Jeffrey Rak’s death is an example of the most tragic result of domestic violence,” Kane County State’s Attorney Joe McMahon said. “Domestic violence is at the root of far more deaths than most people realize.
“We appreciate the patience and the deliberate and detailed work of Kane County Sheriff Don Kramer’s team and the Kane County Major Crimes Task Force,” McMahon said.
“This investigation has been ongoing since Jeffrey Rak’s death occurred nearly four months ago. It required collaboration among the Kane County State’s Attorney’s Office, the Kane County Sheriff’s Office, and the Kane County Major Crimes Task Force, and input from medical and forensic experts. We are pleased that this work has allowed us to bring charges,” McMahon said.
The charges against Daniel Rak are not proof of guilt. Daniel Rak is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove guilt beyond a reasonable doubt.
