The village of Wayne, which has a bit of its footprint in Kane County, is warning residents that fireworks are illegal in the village limits and carry a $150 fine for the first offense.

“In recent years, the Police Department has received a growing number of complaints regarding fireworks,” village officials said in the “Wayne Window” e-newsletter. “In order to more appropriately respond to these calls and for the safety of Wayne’s residents, ordinances have been adopted that make it ‘unlawful for any person to knowingly possess, offer for sale, display for sale, sell at retail, use or explode any fireworks’ within the village limits of Wayne.”

Additionally, loud and unnecessary noise through the “throwing or propelling of any firecrackers, Roman candles or rockets of any type, or any articles of any explosive nature intended to be used as firecrackers” is also prohibited.

Violators of these ordinances will be issued a $150 compliance ticket and fireworks will be confiscated and may result in a court appearance.

Any subsequent violations increases the fines to $225.00 for each additional offense. Each individual firework that is displayed, distributed, or possessed within the village limits shall be deemed a separate violation.

According to a state news release, Illinois law bans commercial fireworks. Consumer fireworks are allowed, to an extent.

Dale Simpson, Fire Prevention Division manager with the Illinois State Fire Marshal’s office, said people can buy sparklers, smoke bombs, firecrackers, and sometimes even bottle rockets.
