An Aurora man has been sent back to prison for unlawfully possessing a gun he was not allowed to possess because of prior gun convictions.

Kane County Circuit Judge Clint Hull sentenced 32-year-old Marcus T. Walker to eight years’ imprisonment in the Illinois Department of Corrections.

A Kane County jury on April 23, 2019, convicted Walker of the offense of armed habitual criminal, a Class X felony.

A person commits the offense of armed habitual criminal when he or she knowingly possesses a firearm after being convicted of at least two qualifying gun-related offenses.

Kane County Assistant State’s Attorneys Matthew Rodgers and Samantha Cain presented evidence that on Oct. 5, 2016, Walker possessed a gun while in Aurora. When being interviewed by Aurora police, Walker admitted that he had recently purchased the gun and that he knew he was prohibited from possessing a gun.

Walker in 2009 was convicted in Kendall County of the offense of unlawful use of a weapon by a felon, and then convicted in 2012 in Cook County of the offense of unlawful use of a weapon by a felon.

Walker served a prison term for each offense.

According to Illinois law, Walker must serve at least 85 percent of the sentence. He receives credit for 1,059 days served in the Kane County jail.
