Kane County Land/Cash Ordinance Draft Now Available For Public Comment

The Kane County Land/Cash Ordinance draft is now available for public comment.

At a land/cash hearing on Tuesday (Nov. 19, 2019), the Kane County Development Committee initiated a public comment period to allow the public to review and comment on proposed revisions to Article V of the Kane County Subdivision Regulations — the article commonly known as the land/cash ordinance.

A land/cash ordinance provides a framework for developers to pay an impact fee of land or the equivalent value in cash to local school districts or park districts. The fee is designed to pay for all or a portion of the costs of providing public school and park sites to a new development.

The land or cash donation is based on the value of land and the number of people or students that the new development might bring.

Article V of the Kane County land/cash ordinance has to do with calculation of fees. The present fair market value of an acre of land in Kane County is set at $80,000, according to the draft ordinance.

Under the revised ordinance, the calculations of fees would be:

Public comment will be permitted until the close of the “Public Comment” period at the Kane County land/cash meeting to be held at 9:45 a.m. Jan. 21, 2020, in the second-floor board room of the Kane County Government Center, 719 S. Batavia Ave., Geneva.

Once public comment is closed at this meeting, no additional comments will be accepted.
