Aurora Man Charged With Possessing Loaded Handgun
An Aurora man faces felony charges for unlawfully possessing a handgun after he threatened to shoot a victim.
Jose D. Silva Alvarez, 32, is charged with the offenses of:
- Aggravated unlawful use of a weapon, two counts, a Class 4 felony.
- Assault, a Class C misdemeanor.
Kane County State’s Attorney Joe McMahon and Aurora Chief of Police Kristen Ziman announce the charges.
Kane County prosecutors allege that the morning of Nov. 29, 2019, Silva Alvarez sent a text message to the victim threatening to shoot the victim, and was in possession of a loaded handgun while on the victim’s property.
Silva Alvarez does not have a valid Firearm Owners Identification card or a Concealed Carry License.
Silva Alvarez appeared Nov. 29, 2019, in Kane County bond court. Kane County Associate Judge Julia Yetter set Silva Alvarez’s bail at $50,000 with 10 percent ($5,000) to apply for bond.
Silva Alvarez on Dec. 3, 2019, posted $5,000 bond and was released. As conditions of bond, he cannot have any contact with the victim, he must stay away from the victim’s residence and he must surrender all firearms to law enforcement.
The charges against Silva Alvarez are not proof of guilt. Silva Alvarez is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove guilt beyond a reasonable doubt.
