Geneva Votes To Allow Cannabis Sales

Geneva Mayor Kevin Burns cast a deciding vote Monday that will allow cannabis sales within city boundaries after the state legalizes adult use on Jan. 1.

According to the city of Geneva website and media reports, Burns’ vote broke a 5-5 City Council deadlock at Monday’s (Dec. 9, 2019) special meeting.

Under the newly revised zoning ordinance, the city will allow one medical cannabis dispensary and one recreational use dispensary.

Cannabis dispensing organizations will be zoned as special uses in the D-CM Commercial Mixed-Use District, D-RSCM Residentially Scaled Commercial Mixed-Use District, B1 Business District, B4 Business District, B5 Business District, I1 Light Industrial District, and I2 General Industrial District.

The ordinance revisions limit the hours of operation — from 8 a.m. to 8 p.m. — and establish a 150-foot separation from schools, day care facilities and residentially zoned properties.

The Geneva City Council prohibited cannabis cultivation centers and will not allow the consumption of cannabis and cannabis-infused products on the premises of any cannabis business establishment.

The state of Illinois passed the Cannabis Regulation and Tax Act (Public Act 101-0027) which legalized possession and consumption of cannabis by adults 21 and over for recreational use. The law goes into effect on Jan. 1, 2020.

Under the Act, municipalities have the ability to regulate local cannabis uses. Municipalities can choose to ban cannabis uses or allow cannabis uses and regulate them through zoning.

The Kane County Board voted to prohibit cannabis sales in unincorporated areas.

Other municipalities in Kane County are at various stages in their decision-making.

The city of St. Charles approved recreational cannabis sales in a 6-3 vote in October. The St. Charles ordinance has these stipulations:

  1. A maximum of two recreational dispensaries may operate in St. Charles.
  2. Recreational dispensaries will only be allowed in the community business zoning districts and regional business zoning districts. Generally, these zoning districts include Main Street/IL Rte. 64 outside the downtown, and also IL Route 38 and Randall Road on the west side.
  3. Only one recreational dispensary may operate on the East Side of St. Charles.
  4. Only one recreational dispensary may operate on the West Side of St. Charles.
  5. Cannabis retailers must be located at least 250 feet away from the property line of any school, day care, church or single-family residence.
  6. No public consumption of cannabis is allowed.
  7. On-site consumption lounges are prohibited.
  8. Cultivation centers are prohibited.
  9. Any other cannabis-related businesses are prohibited.
  10. One of the retail cannabis dispensary must have at least one year of consecutive experience operating a medical cannabis dispensary in St. Charles; the other dispensary must have one year of consecutive experience in the state of Illinois.
