A Hanover Park man faces criminal charges for allegedly selling LSD and marijuana.

Kane County State’s Attorney Joe McMahon has charged 21-year-old Dawid M. Byrgiel with the offenses of:

• Two counts of unlawful delivery of LSD, a Class X felony.
• Unlawful delivery of cannabis, a Class 2 felony.

Kane County prosecutors allege that on Nov. 1, and Nov. 5, 2019, Byrgiel sold between 200 and 600 units (hits) of lysergic acid diethylamide, and that on Dec. 17, 2019, Byrgiel sold between 500 and 2,000 grams of marijuana.

Byrgiel appeared Dec. 18, 2019, in Kane County bond court. Kane County Associate Judge Sandra Parga set Byrgiel’s bail at $85,000, with 10 percent ($8,500) to apply for bond.

Parga set Byrgiel’s next court appearance for 9 a.m. Jan. 3, 2019, in Courtroom 217 at the Kane County Judicial Center.

Byrgiel posted $8,500 bond on Dec. 18 and was released.

If convicted of the most serious offense, Byrgiel faces a sentence of between four and 15 years of imprisonment in the Illinois Department of Corrections.

The North Central Narcotics Task Force conducted the investigation.

The charges against Byrgiel are not proof of guilt. Byrgiel is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove guilt beyond a reasonable doubt.
